2.1 By submitting this Membership Application Form the member agrees to comply with these Terms and Conditions and NCSFA’s By-Laws. (current copy available on website)
2.2 You will only be granted access to all the Association’s benefits and website member areas provided your membership is current and fully paid or if you have made payment arrangements acceptable to NCSFA’s current executive board.
3. Membership Categories:
3.1 NCSFA offers two different types of membership which are set out on the printable or online membership application form. Your choice of membership on joining will determine the amount you pay and any voting restrictions that may apply as per section 1.2 below.
3.2 ACTIVE members acquire one (1) vote at members’ legal meetings. ASSOCIATE members may attend these legal meetings but retain NO voting rights.
4. Duration and Payments:
When you join NCSFA you are agreeing to remain a member for the Commitment Period. If you pay for your membership using the online form, the payment method (credit card) that you used will automatically be charged (3 days before) the Commitment Period end date at the stated rate applicable to your membership type. You may choose to deselect the recurring payment option when joining, but it will be your responsibility for renewing your membership at least 5 days before your membership is due to expire. Renewal payments made up to 30 days after the commitment period will incur a $10 late-fee and any late renewals will abide by the initial commitment period term.
5. Termination of Membership:
5.1 Termination by NCSFA
We may terminate this agreement in the following circumstances:
(a) if you commit a serious or repeated breach of this agreement and/or NCSFA’s by-laws, if capable of remedy, is not remedied within 7 days of receipt of a default notice;
(b) If any part of your membership fee remains unpaid 30 days after its due date for renewal, or
(c) If you provide us with details which you know to be false when applying for membership and the false declaration would have reasonably affected our decision to grant you membership.
If we terminate for any of these reasons, we reserve the right to retain a proportion of the money paid under this agreement, to cover any reasonable costs incurred.
5.2 Termination by You
You may terminate this agreement in the following circumstances:
(a) You can give notice to terminate at any point during the Commitment Period but this cannot end your membership before the end of the Commitment Period.
(b) You choose to deselect the recurring payment method and fail to renew your membership within the 30 day late renewal period. If you wish to renew your membership after this 30 day late renewal period, your application will have to be reviewed again by the Executive board and will incur a $20 reinstatement fee along with the set membership category cost of joining.
6. NCSFA By-Laws:
NCSFA may amend the by-laws from time to time in order to ensure the overall longevity of the Association. Temporary amendments (if any) will be displayed on the website. Permanent changes to the by-laws will only be made after a full vote and at will include an online notice at least 30 days prior to inclusion.
